Are decisions made in mediation legally binding?

No, proposals made in mediation do not constitute binding agreements.

If you have applied for a divorce or a dissolution order in the case of a civil partnership then it is usual for the judge to make an order based on your agreement. This is called a Consent Order and it becomes binding on the granting of the decree absolute. One of your solicitors will draft it and the other solicitor will receive a copy.

Alternatively, if you are not going through divorce proceedings or the dissolution of a civil partnership, one of your solicitors can draft a binding separation agreement.
